Welcome to Forebrain (“Forebrain”, “we”, “us”, “our”), a voice-first productivity app designed for people who think out loud. These Terms of Service (“Terms”) govern your access to and use of the Forebrain mobile application, website, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
You must be at least 13 years old to use Forebrain. If you are under the age of majority in your jurisdiction, you must use Forebrain under the supervision of a parent or legal guardian who agrees to these Terms.

Description of Service
Forebrain is a voice-first productivity application that helps users capture ideas, set daily focus, and process thoughts through voice recordings. Our Service includes features such as morning check-ins, evening brain dumps, voice-to-text transcription, and AI-generated insights to help you organize and act on your ideas. We may offer free and paid subscription tiers with varying levels of access to features and storage.

User Accounts
To use Forebrain, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You may delete your account at any time through the app settings.

Privacy and Voice Data
Forebrain processes your voice recordings to provide transcription and AI-powered insights. By using the Service, you consent to the collection, processing, and storage of your voice data as described in our Privacy Policy. We take the security of your personal data seriously and implement appropriate technical and organizational measures to protect it.

Intellectual Property Rights
Forebrain owns all rights, titles, and interests in the Service, including but not limited to the app design, features, branding, and any original content we provide. Your voice recordings and the content you create remain yours.

User Content
You retain ownership of all voice recordings, transcriptions, notes, and other content you create using Forebrain (“User Content”). By using the Service, you grant Forebrain a limited license to process, store, and display your User Content solely for the purpose of providing and improving the Service. You represent and warrant that your User Content does not violate any third-party rights or applicable laws.

Subscription and Payments
Forebrain may offer paid subscription plans. If you purchase a subscription, you agree to pay the applicable fees and any taxes. Subscriptions automatically renew unless canceled before the renewal date. You may cancel your subscription at any time through your device’s app store settings. Refunds are handled in accordance with the policies of the applicable app store.

User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service
- Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Use the Service to infringe on any third-party rights
- Reverse engineer, decompile, or disassemble any part of the Service

Disclaimers and Limitations of Liability
Forebrain provides the Service “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. AI-generated insights are provided for informational purposes only and should not be relied upon as professional advice.
To the maximum extent permitted by law, Forebrain shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.

Indemnification
You agree to indemnify and hold harmless Forebrain, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

Changes to the Service and Terms
Forebrain reserves the right to modify, suspend, or discontinue the Service or these Terms at any time. We will provide notice of significant changes to the Terms through the app or via email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

Termination
You may stop using the Service at any time. Forebrain may suspend or terminate your access to the Service for any breach of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease, though you may request export of your User Content in accordance with our data retention policies.

Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, or in a court of competent jurisdiction in Pennsylvania.

Miscellaneous
These Terms constitute the entire agreement between you and Forebrain regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
